TERMS OF SERVICE

1. Purpose of the General Conditions of Use

The purpose of these General Conditions of Use (hereinafter “CGU”) is to define the rules applicable to any visit to the site of the Francophone Youth Council of British Columbia (CJFCB) and to any use of the services accessible through it. herein by a user (hereinafter, the “User”).

2. Application of the CGU

The Francophone Youth Council of British Columbia (“CJFCB”) administers a website with a password-protected Member Area (https://www.cjfcb.com) through which its community can access certain information, events, news and services (collectively, the “User Profile”). This User Account Agreement and the documents to which it refers, including the Terms of Use at https://cjfcb.com/mentions-legales (the “Terms of Use”; together, the “Agreement”) set forth the conditions applicable to the creation of an account for the use of the Website (your “Profile”).

By creating a Profile or using Content, you agree to comply with the terms of this Agreement, which CJFCB may modify from time to time in accordance with the conditions described below.

By creating your User Profile, you accept the terms of this Agreement and agree to be legally bound by them; if you do not accept them, do not create a User Profile, or click on “delete my profile” or contact the administrator at information@cjfcb.com.

For the purposes of this Agreement, “you” and “your” means you and anyone who accesses or uses the Website using your Profile. You are solely responsible for all access to and use of the Website, by you or anyone else, using your Profile.

1. Username and password

It is only possible to access your Profile through your username and password. You are solely responsible for the use, abusive or not, of your Profile, username and password, as well as anything that results from it. As a security measure, you must keep your username and password confidential, that is, do not reveal them to anyone or allow anyone to use them. The CJFCB recommends that you choose a password that is unique to you and that is difficult to guess. You should change your password regularly and log out at the end of each session.

The Profiles remain the property of CJFCB, which may suspend or terminate them at any time, without incurring liability to you or anyone else. CJFCB is under no obligation to verify the true identity or authority of anyone using your username and password.

You must notify CJFCB immediately if your username and password are used without authorization or if you know or suspect that they are lost, stolen or known to anyone or have been otherwise compromised. The CJFCB cannot be held responsible for your failure to notify it or for any delay in suspending your Profile following receipt of notice.

2. Registration

When registering, you will need to provide your name and an email address, choose a password and provide other information. You certify that the information you provide will be complete and accurate, that you will provide a valid email address, that you will not impersonate any person or entity, and that you will not attempt to deceive the CJFCB in any way. another way. 4. Changes

5. Confidentiality and protection of personal information

The CJFCB privacy policies (available here; “Privacy Policies”) are an integral part of this Agreement. You consent to the CJFCB collecting, using and disclosing the information necessary to open your Profile, including personal information about you, in accordance with the confidentiality policies.

You acknowledge that CJFCB may monitor your use of the Website through your User Profile. You further acknowledge that the CJFCB, subject to its confidentiality policies, may disclose information about your use of your Profile and the Website to the extent required by law or regulation, or to access at the legitimate request of a competent government or territory.

Being subject to the Privacy Act and the Access to Information Act of Canada, the CJFCB only collects, protects, uses and discloses information (including personal information) in accordance with them. this. 6. Presentation of Contributions

You grant to CJFCB a perpetual, irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, translate, license, transmit, distribute and otherwise exploit (including creating derivative works) in whole or in part the comments, information, photos, ideas, concepts, evaluations and other content forming part of any communication published, uploaded or presented through your Profile in any way, on any medium and by any current or future technological means whatsoever. You irrevocably waive all moral rights.

The CJFCB is under no obligation to review, sort, monitor, delete or edit any Contributions, but reserves, in its absolute discretion, the right to do so at any time and at its discretion. , with or without reason, as well as the right to refuse, delete, move or modify any Contribution in whole or in part, with or without notice. The CJFCB cannot be held responsible for damages of any kind arising from a Contribution, even when it has been informed of their possibility, or for the modification or deletion of a Contribution.

7. Right of use

As long as you comply with the terms of this Agreement, you are granted the limited, non-exclusive, non-transferable right and license to view and use the Content through your Profile; However, you are prohibited from adapting or reselling it, as well as using it in whole or in part to create a commercial product. Your Profile, the Website and the Content belong to the CJFCB; you acknowledge and agree that you have no ownership or other rights with respect to it, except those provided for in this Agreement.

8. Prohibited activities

In addition to this Agreement, you agree to use your Profile in accordance with applicable laws and regulations (in particular regarding copyright). Furthermore, except to the extent expressly permitted by this Agreement, you acknowledge that you do not have the right:

a) copy, reproduce, distribute, transfer, sell, license, publish, modify, upload, transmit or exploit in any way (including by inclusion in database, creation of derivative works or reference by hyperlink) your Profile, the Website or the Content, neither in whole nor in part;

b) use your Profile or the Website to conduct or facilitate an activity that infringes the intellectual property rights of anyone;

c) copy, modify, alter, remove or deface any trademarks, service marks and other intellectual property available or accessible through your Profile, or use them for purposes other than those for which they are made available to Profile users;

d) use your Profile or the Website to invade the privacy of others or to collect or store the personal data of other users;

f) upload, download, publish, retrieve, transmit or otherwise reproduce, distribute or make available information, software and other content that:

i) are confidential, are protected by copyright or are the subject of other intellectual property rights without prior authorization of the holder(s) concerned;

(ii) is defamatory, obscene or hateful, or constitutes child pornography;

iii) constitutes an intrusion into the privacy of any person or an impersonation, or contains unauthorized links or framing;

g) to make any use that the CJFCB declares prohibited or inappropriate.

9. Limitation of liability

Except as expressly provided in this Agreement and its successive versions, the CJFCB and its agents, employees, directors, and officers, as well as any person associated with the creation or use of the Profile or the website expressly disclaims any liability for to any express or implied representation, warranty or condition with respect to the Profile, the Website or the Content (which are provided "as is" and as available), including the implied warranties and conditions of merchantability, fitness for a particular use, of title and of absence of infringement, as well as those arising from the law, from habitual behavior or from commercial usage.

The CJFCB does not represent or guarantee:

a) that your Profile, the Website and the Content are accurate, complete, correct, current, reliable, timely, useful or appropriate for your needs;

b) that your Profile, the Website and the Content will meet your expectations;

c) that access to your Profile and the Website will be fast, secure and free from interruptions and errors;

d) that the content will be free of viruses, worms, Trojan horses or other code that may harm your device.

You acknowledge and agree:

a) that you use your Profile, the Website and the Content at your own discretion and risk,

b) that you are solely responsible for any damage you may suffer due to:

i) damage to your device or loss of data resulting from the download of Content,

ii) the faith you place in the Content available through your Profile or through the Website, or;

iii) any other damage. Under no circumstances will the CJFCB be responsible for the use you make of your Profile or the website.

If the liability of the CJFCB or one of its Agents is recognized for any loss or damage directly or indirectly attributable to your Profile, the Website or the Content, this liability cannot exceed one thousand dollars (1 000 $).

Under no circumstances will the CJFCB or its Agents be liable for any direct, indirect, punitive, special, incidental, exemplary or consequential damages for loss of use, data, profits or exploitation, or arising in any way whether from the use or performance of your Profile, the Website, the Content or a linked website; any information or data obtained through your Profile or on the Website; your use of your Profile or the Website; your inability to use them; any decision or action taken based on information or Content available through your Profile or on the Website, or an error or omission in the Content, whether such damages are based on tort, contractual or strict, or even on negligence, even if the CJFCB has been informed of their possibility.

10. Suspension, termination and cancellation

The CJFCB reserves the right, in its sole discretion and without incurring liability, to cancel, terminate, restrict or suspend your access to the Website, or delete your Profile, if it has reasonable grounds to believe that you contravene, or will contravene, the terms of the Agreement or applicable laws. This right is in addition to, and not in lieu of, other rights and remedies that the CJFCB may exercise under the Agreement or the law.

The CJFCB may close your Profile at any time by providing you with notice, in accordance with the terms of the Agreement. You can close your Profile by contacting the CJFCB using the contact details provided on the Website.

You can delete your Profile yourself at any time via the “Delete my profile” button. You also have the option to delete your Profile after participating in the events if desired.

11. Responsibility of minors

As a prerequisite to the creation and use of your Profile, you declare and certify that you have reached the age previously defined by the CJFCB, i.e. 14 years. If you allow a person who is not at least 14 years old to use your Profile, you agree that you are entirely responsible for:

(a) the conduct of that person;

b) controlling access to and use of the Profile by that person;

c) the consequences of any use, abusive or not, of your Profile by this person.

12. Entire agreement

This Agreement constitutes, together with the Terms of Use, the confidentiality policies and any other act incorporated or cited herein, the entire agreement between you and the CJFCB concerning the subject matter hereof. It cancels and replaces all conventions, understandings, negotiations and discussions previously made electronically, verbally or in writing, and may only be modified in the manner provided herein. In the event of any conflict between this Agreement and the Terms of Use or any other document incorporated herein by reference, this Agreement shall take precedence to the extent necessary to resolve the conflict.
